Jaret & Jaret was co-counsel in a class action lawsuit in 2004, Foothill-De Anza Community College District v. Northwest Pipe Company, filed in U.S. District Court, Northern District of California (San Jose), which sought damages on behalf of their client Foothill-De Anza and others similarly situated for the Poz-Lok Sprinkler Fire Protection System, which had design and manufacturing defects resulting in leaks and other failures. A nationwide class was certified and a 14.5 million dollar settlement fund was established to pay claims for pipe repair, replacement and consequential damages. Jaret & Jaret was also counsel for Foothill-De Anza Community College District in 2009 before a three member American Arbitration Association panel against the architect, Anshen & Allen, in connection with a defectively designed HVAC and its fume hood system in its chemistry labs at De Anza College. The AAA arbitrators awarded the District approximately 2.5 million as compensation for the required retrofit and costs and attorneys fees as prevailing party. Public Contract Law Letters
